SC Asks EC Not To Make Bypoll Notification Until Nov 10

A bench headed by Chief Justice DY Chandrachud led a special-session court on Thursday to hear and decide for himself the appeal of Khan seeking to delay his sentencing so that he survives disqualification as a legislator

The Supreme Court on Wednesday ordered the Election Commission not to give notice of the meeting until Nov. 10 at a poll held in Rampur Sadar in Uttar Pradesh, which became vacant following the disqualification of Samajwadi party MLA Azam Khan following his conviction in a case with incitement to hatred.

A bench headed by Chief Justice DY Chandrachud led a special-session court on Thursday to hear and decide the appeal of Khan seeking to postpone his sentencing so that he survives disqualification as a legislator.

The Supreme Court said the election commission may issue the bypoll notice on or after Nov. 11 once the hearing court decides on Khan’s plea.

On October 27, Khan was convicted in the hate speech case and sent to three years in prison by a court in Rampur.

The MP-MLA court in Rampur has also released the MLA on bail in the 2019 case.

On October 28, the Secretariat of the Legislative Assembly of Uttar Pradesh had announced Khan’s disqualification from the House.
